Article I. EMPLOYEE DEFINED CONTRIBUTION PLAN |
§ 22-7. Amendments.
(a)
Adoption.
(1)
Amendment No. 1: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of July 1, 2001, Amendment No. 1 to [the] employee retirement system of Altus, Oklahoma, pertaining to the revision to update the city's master defined contribution plan joinder agreement with the Oklahoma Municipal Retirement Fund (OMRF) to include the latest Internal Revenue Service (IRS) definitions and more user-friendly IRS language, an executed counterpart of which is marked exhibit A and attached to the ordinance from which this subsection is derived as a part thereof.

Amendment No. 2: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of March 1, 2002, Amendment No. 2 to [the] employee retirement system of Altus, Oklahoma, pertaining to the revision to the city's master defined contribution plan joinder agreement with the Oklahoma Municipal Retirement Fund (OMRF) to exclude the city administrator from the city employees' defined contribution plan, an executed counterpart of which is marked exhibit A and attached to the ordinance from which this subsection is derived as a part thereof.

Amendment No. 3: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of March 1, 2002, Amendment No. 3 to [the] employee retirement system of Altus, Oklahoma pertaining to the revision to the city's master defined contribution plan joinder agreement with the Oklahoma Municipal Retirement Fund (OMRF) to include the city administrator in the city managers' defined contribution plan, an executed counterpart of which is marked exhibit A and attached to the ordinance from which this subsection is derived as a part thereof.

Amendment No. 4: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of March 18, 2003, Amendment No. 4 to [the] Employee Retirement System of Altus, Oklahoma, pertaining to the revision to the city's master defined contribution plan joinder agreement with the Oklahoma Municipal Retirement Fund (OMRF) providing for limitation on contributions, increase in compensation limits, rollover of plan distributions, rollover from other plans and required minimum distributions; and an executed counterpart of which is marked exhibit A and attached hereto as a part hereof.

Amendment No. 5: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of March 18, 2003, Amendment No. 5, to [the] Employee Retirement System of Altus, Oklahoma, pertaining to the revision to the city manager defined contribution plan joinder agreement with the Oklahoma Municipal Retirement Fund (OMRF) providing for limitations on contributions, increase in compensation limits, rollover of plan distributions, and rollover from other plans, an executed counterpart of which is marked exhibit A and attached hereto as a part hereof.

Amendment No. 6. Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of March 3, 2009, Amendment No. 6, to [the] Employee Retirement System of Altus, Oklahoma, Defined Contribution Plan pertaining to changes to comply with required IRS language and impacting the definition of "compensation" (as used in measuring benefit limits) when a participant has terminated employment.

Amendment No. 7: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of October 20, 2009, Amendment No. 7 to [the] Employee Retirement System of Altus, Oklahoma, Defined Contribution Plan for the position of city administrator with the Oklahoma Municipal Retirement Fund (OMRF) as approved in the emergency passage of City Ordinance No. 09-19 pertaining to 1) change the participating employee from city manager to city administrator; 2) changes to comply with required IRS language; 3) inserting the definition of "compensation" excluding severance pay and fringe benefits; and 4) approving a new joinder agreement between the city and OMRF, attached as exhibit "A" and a new plan document attached as exhibit "B", to Emergency Ordinance No. 09-19.

Amendment No. 8: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of October 20, 2009, Amendment No. 8 to [the] Employee Retirement System of Altus, Oklahoma, City of Altus Defined Contribution Plan with the Oklahoma Municipal Retirement Fund (OMRF) for eligible employees as approved in the emergency passage of City Ordinance No. 09-18 pertaining to 1) allowing employees to make their own investment choices; 2) allowing employee loans; 3) changes to comply with required IRS language; 4) benefits; and 5) approving a new joinder agreement between the city and OMRF, attached as exhibit "A" and a new plan document attached as exhibit "B" to Emergency Ordinance No. 09-18.

Amendment No. 9: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of July 1, 2014, Amendment No. 9, to [the] Employee Retirement System of Altus, Oklahoma, Defined Contribution (DC) Plan, pertaining to the definition of employee, to not include any person who is in the position of city manager or assistant city manager and is currently accruing benefits under another retirement system which has been approved by the city council under a revised joinder agreement attached as exhibit A, as approved in the emergency passage of OMRF Ordinance No. 2014-10 on July 1, 2014.

Amendment No. 10: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of July 1, 2014, Amendment No. 10, to [the] Employee Retirement System of Altus, Oklahoma, adopting an Employee Retirement System Defined Contribution Plan for the position of Assistant City Manager for the City of Altus, Oklahoma, as approved in the emergency passage of City Ordinance No. 2014-12 pertaining to plan design and approving a new joinder agreement between the city and OMRF, attached as exhibit A and a Master Defined Contribution Plan, attached as exhibit B to said Emergency OMRF Ordinance No. 2014-12, passed and approved on July 1, 2014.

Amendment No. 11: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of October 1, 2015, Amendment No. 11, to Employee Retirement System of Altus, Oklahoma, adopting a revised and restated employee retirement system, and amending the defined contribution plan for the position of assistant city manager for the City of Altus, Oklahoma, as approved in the passage of City Ordinance No. 2015-13 pertaining to adding IRS required changes, adding changes necessary to allow for a daily recordkeeping platform, with a new joinder agreement between the city and OMRF, attached as exhibit A and an amended and restated defined contribution plan, attached as exhibit B to said OMRF Ordinance No. 2015-13, passed and approved on August 18, 2015.

Amendment No. 12: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of October 1, 2015, Amendment No. 12, to employee retirement system of Altus, Oklahoma, adopting a revised and restated employee retirement system, and amending an employee retirement system defined contribution plan for the position of city manager for the City of Altus, Oklahoma, as approved in the passage of City Ordinance No. 2015-15 pertaining to adding IRS required changes, adding changes necessary to allow for a daily recordkeeping platform, with a new joinder agreement between the city and OMRF, attached as exhibit A and an amended and restated defined contribution plan, attached as exhibit B to said OMRF Ordinance No. 2015-15, passed and approved on August 18, 2015.

Amendment No. 13: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of October 1, 2015, Amendment No. 13, to employee retirement system of Altus, Oklahoma, Altus DC Plan, adopting a revised and restated employee retirement system, and amending an employee retirement system defined contribution plan for the position of eligible employees of the City of Altus, Oklahoma, as approved in the passage of City Ordinance No. 2015-17 pertaining to adding IRS required changes, adding changes necessary to allow for a daily recordkeeping platform, with a new joinder agreement between the city and OMRF, attached as exhibit A and an amended and restated defined contribution plan, attached as exhibit B to said OMRF Ordinance No. 2015-17, passed and approved on August 18, 2015.

Amendment No. 14: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of November 1, 2015, Amendment No. 14, to Employee Retirement System of Altus, Oklahoma, Altus DC Plan, adopting a revised definition to "employee" to exclude any person who holds the position of city manager on or after May 18, 2015, as approved in the passage of OMRF Ordinance No. 2015-29 likewise revising the definition of "employee," with a new joinder agreement between the city and OMRF, attached as exhibit "A" as passed and approved on November 17, 2015.

Amendment No. 15: Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of November 1, 2015, Amendment No. 15, to Employee Retirement System of Altus, Oklahoma, Altus DC Plan, adopting a revised definition to "employee" to exclude any person who holds the position of assistant city manager on or after August 19, 2015, as approved in the passage of OMRF Ordinance No. 2015-27 likewise revising the definition of "employee," with a new joinder agreement between the city and OMRF, attached as exhibit "A" as passed and approved on November 17, 2015.

Amendment No. 16 : Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of September 1, 2016, Amendment No. 16, to Employee Retirement System of Altus, Oklahoma, Altus DC Plan, adopting a revised definition to "employee" to include any person who holds the position of city manager on or after September 1, 2016, so that the city manager will be in the OMRF CMO Plan #1, as approved in the passage of OMRF Ordinance No. 2016-19 likewise revising the definition of "employee," with a new joinder agreement between the city and OMRF, attached as exhibit "A" as passed and approved on August 2, 2016.

Amendment No. 17 : Pursuant to the authority conferred by the laws of the state, and for the purpose of encouraging continuity and meritorious service on the part of the city employees and thereby promote public efficiency, there is hereby authorized, approved, and adopted, effective as of September 1, 2016, Amendment No. 17, to Employee Retirement System of Altus, Oklahoma, Altus DC Plan, adopting a revised definition to "employee" to include any person who holds the position of assistant city manager as of July 1, 2014, so that the assistant city manager will be in the OMRF CMO Plan #2, as approved in the passage of OMRF Ordinance No. 2016-21 likewise revising the definition of "employee," with a new joinder agreement between the city and OMRF, attached as exhibit "A" as passed and approved on August 2, 2016.
