§ 28-153. User charge system.

(a)

As the BOD ₅ , suspended solids, and other pollutant concentrations discharged shall be approximately equal for all domestic-type users, users shall be charged on a volume basis in accordance with the following formula:

Symbols and definitions:

C _u  = A user's charge for O&M per unit of time.

C _b  = A user's base minimum charge (for debt retirement, billing, administration, etc.) per unit of time.

C _t  = Total operation and maintenance (O&M) costs per unit of time.

V _t  = Total volume contribution from all users per unit of time (may include extraneous flows).

V _u  = Volume contribution from a user per unit of time.

(b)

Each user shall be notified at least annually, by new billing, of the sewer use rate and portion of the user charges which are attributable to wastewater treatment services. Costs shall be broken down to show the operation and maintenance cost attributable to that user.

(c)

A record-keeping system shall be established and maintained by the city to document compliance with federal regulations pertaining to the user charge ordinance.

(d)

The user charge system and ordinance shall be reviewed not less often than every two (2) years regarding the wastewater contribution of users and user classes, the total costs of the operation and maintenance of the treatment works, and its approved user charge system. The charges for users or user classes shall be revised to accomplish the following:

(1)

Maintain the proportionate distribution of operation and maintenance costs among users and user classes.

(2)

Generate sufficient revenue to pay the total operation and maintenance costs necessary to the proper operation and maintenance (including replacement) of the treatment works.

(3)

Apply excess revenue collected from a class of users to the costs of operation and maintenance attributable to that class for the next year, and the rates shall be adjusted accordingly.

(e)

The user charge system and requirements of this division shall take precedence over any items or conditions of agreements or contracts between the city and any of the users which are inconsistent with applicable federal regulations regarding user charge systems.
